Ancora problemi per il Rally di Monte Carlo. Stavolta ad essere sotto attacco è il servizio di cronometraggio usato dal WRC e sviluppato interamente da una piccola società, la Stage One Technology, non collegata a North One Sport. Pare che i legali di NOS o quelli dei suoi creditori stiano cercando di fermare la società di servizi S1T in modo che non possano fornire il servizio di cronometraggio per il WRC al Rally di Montecarlo.

Simon De Banke, amministratore della S1T, ha inviato pertanto una lettera aperta agli amministratori di NOS e CSI, la lettera è stata indirizzata anche alle principali riviste del settore. Riportiamo la traduzione e la versione in inglese, se ci sono errori di traduzione vi esorto a segnalarli tramite commento:

“Lettera aperta: FIA WRC – facciamo qualcosa di positivo

Come ho già scritto, l’apparecchiatura per il cronometraggio e il sistema di monitoraggio sono in viaggio per Valence cosicchè possano fornire i risultati della gara a milioni di fans di tutto il mondo, e il sistema di monitoraggio per proteggere i piloti e gli spettatori sulle montagne ghiacciate del Rally di Monte Carlo.

Parte di questa apparecchiatura apparteneva a North One Sport, e gli specialisti di Stage One Technology lo hanno sviluppato e usato per voi in tutti questi anni negli ultimi 10 anni e più.

Come sapete, NOS doveva molti soldi a S1T e ai suoi fornitori. Quando è stato chiaro che NOS non avrebbe potuto pagarci e che l’accordo con gli investitori che avrebbero dovuto acquistare NOS è saltato vi abbiamo avvisato che avremmo confiscato l’apparecchiatura per il cronometraggio e il sistema di monitoraggio per essere almeno in grado di continuare a fare il nostro lavoro.

Per quanto ci riguarda abbiamo completato il processo di sequestro dei beni per mancato pagamento e con soddisfazione possiamo dire di avere più di qualsiasi altro il diritto alla proprietà/possesso di queste apparecchiature.

Stamattina abbiamo ricevuto una lettera dagli avvocati che ci informavano la vostra intenzione di usare tutte i mezzi legali in vostro possesso per provare a fermarci dall’usare l’apparecchiatura al Monte Carlo. Spero vi rendiate conto delle conseguenze se questo dovesse succedere.

A differenza di North One Sport, North One Televisione / All 3 Media e Hacker Young, Stage One Technology è un’azienda piccola e indipendente composta da un team di persone ( la maggior parte delle quali ha lavorato a queste apparecchiature del WRC per più di 10 anni ) a cui non importa della vostra politica o della pubblicità. Noi vogliamo solo fare il nostro lavoro e fare la nostra parte in modo che il WRC possa continuare.

Queste attrezzature non hanno nessun valore per voi. C’è solo un team di persone al mondo che sa come farle funzionare! Solo due persone sanno come ripararle se qualcosa dovesse andare storto. Queste persone fanno parte del nostro team. Anche se riusciste ad accendere le apparecchiature queste non funzionerebbero senza il software che è stato sviluppato, pagato e che ci appartiene completamente. In breve, queste apparecchiature sono senza nessun valore per qualsiasi altra persona tranne che per Stage One Technology. Darebbe solo valori di nessuna utilità pratica dato che non potrebbe fare nulla da solo. Sarebbe come provare a vendere un foglio di Excel vuoto – che sarebbe invece molto utile se riempito con le varie formule e funzioni – ma invece è vuoto!

Mi batterò fino alla morte per proteggere il mio team meraviglioso, umile, diligente e professionale e non mi interessa di poter trarre profitto da questa ignobile situazione.

Quindi, fatto salvo che la nostra attuale posizione sulla proprietà delle attrezzature è migliore della vostra, propongo a NOS il seguente accordo. Se all’ 1 pm di oggi ( 10 gennaio 2012 ), ci confermerete di non avere nessun diritto, titolo o interesse su queste apparecchiature ( di nessun valore per voi / creditori di NOS ), e che non farete causa a Stage One Technology o alle società collegate, per nessun tipo di risarcimento danni e allo staff o ai dirigenti per il continuo uso e possesso delle apparecchiature, Io mi impegno a trasformare la Stage One Technology in una organizzazione al 100% no-profit, che devolverà ogni penny dei suoi profitti in cause socialmente utili, come l’incredibile fondazione Make A Wish, per aiutare i bambini a ritrovare un sorriso, avere la possibilità di salire su una vettura WRC, incontrare i loro eroi e volare in posti esotici per provare la stessa passione di cui voi siete stati testimoni in questi ultimi 10 anni.

E inoltre, ci impegneremo, a patto di poter usare al Rally di Monte Carlo senza interferenza alcuna la nostra apparecchiatura, a pagarvi 10.000 sterline per l’apparecchiatura, che è assolutamente senza valore per voi.

Mi dispiace moltissimo per lo staff che avete dovuto licenziare e per le tante vite che sono ora affette da questa terribile situazione. Spero sinceramente che vi uniate a noi per permetterci di fare qualcosa di straordinariamente positivo e uscire da tutto questo, e lasciare una generosa eredità a tutti gli appassionati e supporters del Campionato del Mondo Rally.

Facciamo in modo che da tutto questo ne esca qualcosa di buono. Lo staff di S1T e io aspettiamo una vostra risposta.

As I write, the WRC Timing and Safety Tracking Systems are en route to Valence in order to assist in providing the results for the millions of fans around the world, and the safety tracking to help protect the competitors and spectators on the icy mountain stages of Rallye Monte-Carlo.

Parts of this system used to belong to North One Sport, and the dedicated team at Stage One Technology has developed and operated it for you, diligently and quietly for the last 10+ years.

As you know, Stage One Technology is owed a substantial sum of money by North One Sport which has put the jobs of the passionate S1T team, and those of its suppliers on the line. When it became clear that it was unlikely we would be able to be paid, we gave you notice that we would seize the timing and tracking systems in order to at least allow us the opportunity to continue to trade should the worst happen and you were unable to find a firm offer to buy NOS before time ran out.

Time did run out. And as far as we know, no firm offer was put in front of the FIA, although I can still understand how upset you would feel that in the final hours a very credible buyer seemed to be close to a deal.

As far as we are concerned we have completed the process of seizure of the assets for non payment and are satisfied we have a greater right to title to/possession of the equipment than any other party.

This morning we have received a letter from your lawyers indicating that you intend to use every legal means necessary to try to stop the systems being used in Monte Carlo. I expect you are fully aware of the consequences, should this happen.

Unlike North One Sport, North One Television / All 3 Media and Hacker Young, Stage One Technology is a small, independent company which employs a team of people – most of which have worked on the WRC systems for most of its ten year history – who don’t care about the politics or the commercials. We just want to get the job done, and play our part in making the WRC all it can be.

The systems are valueless to you. There is only one team of people in the world who knows how to turn them on! Only two human beings alive who know how to repair them when they go wrong. These people are part of our team. Even if you managed to switch the systems on, they don’t actually do anything without critical software which was developed by, paid for and is owned entirely by us. In short, these systems are of absolutely no value to anyone other than Stage One Technology. It would fetch only scrap value on the open market, as it simply doesn’t do anything on its own. It would be like trying to sell a blank Excel Spreadsheet – of course it could be very useful if it were filled in with formulae and functions, but it isn’t – it’s blank!

Whilst I will fight to the death to protect my amazing, humble, diligent, professional and hard working people, I do not care to personally profit from this disappointing situation.

So without prejudice to our current position that we are the party with the best claim to the equipment, I make NOS the following proposal. If by 1pm today (10 January 2012), you write to confirm you will not seek to assert any right, title or interest over these (valueless to you / the creditors of NOS) systems, and that you will not seek any kind of damages against Stage One Technology or it’s associated companies, staff or directors relating to their continued use and possession of the equipment, I pledge to turn Stage One Technology into a 100% non-profit organisation, which will put absolutely every penny of its profits into worthwhile causes, such as the incredible Make A Wish foundation, to give kids who’s daily routine make everything we’re dealing with now seem like a weekend in the Bahamas, the chance to ride in World Rally Cars, meet their heroes and fly to exotic places to experience the same excitement and passion you’ve had the enormous privilege to witness first hand for the last 10+ years whilst also making an incredible living.

And in addition, we will, subject to us successfully using the equipment in Monte Carlo without interference, pay you £10,000 for this equipment – which is entirely valueless to you, except as scrap value.

I feel terrible for the staff you have lost and the many lives that have been affected by this terribly regrettable situation. I sincerely hope you will join us now in allowing something extraordinarily positive to come out of all of this, and leave behind a generous legacy to the fans and supporters of the World Rally Championship.

It is in your power to make something good come out of all of this. The staff of Stage One Technology, and I await your response.
